We are simply providing a free platform to link buyers and sellers of water rights. It is up to the buyer and seller to come to an mutual agreement. We recommend that a sales agreement is mutually agreed upon and signed by both parties. Our office can help assist with the sale, title paperwork, and filing any Water Rights Applications and Maps required.
There are no fees to list on our website, and we never post your information online. It is free to all, including Water Rights Attorneys, Real Estate Agents, and Water Rights Agents. However, we will gladly research any water rights you are thinking of purchasing to verify they are in good standing. We can also facilitate the water rights transfer by preparing the deed for recording with the County and filing paperwork with the State Engineer's office. We will also gladly perform any water rights transfers, change applications, or maps required.
Water Rights are considered Real Property in the State of Nevada and can be bought and sold as such. A deed will need to be prepared, and recorded within the County the Water Rights are Located In. Our office can perform these services.
If you are using surface water or water from a spring for any purpose in Nevada you will need a water right. Additionally if you are using water from a well (groundwater), you will need a water right as well. The only exception is a 2.0 acre-foot domestic well credit exemption for Domestic (Household) Use. This domestic well credit (exemption) is only applicable for parcels that cannot connect to a municipal water system. You can apply for a water right; however, typically water rights will only be granted where there is unappropriated water in the State (such as Basins in remote rural areas).
Typically you will need to purchase 2.0 acre feet of water rights for each new lot you are creating that will be served by a domestic well. You will buy water rights, and then have to "Relinquish" them in favor of Domestic Well Use. Our office can assist with this process.
Unfortunately unless you are buying land with the water rights, the answer is probably "No". You will need to file a Change Application with the State Engineer's Office (Nevada Division of Water Resources) in order to use your water right as desired. Our office can perform all aspects of water rights transfers so that you apply to use your water right as needed including Applications and Maps. Any change applications or applications for that matter are ultimately up to the Nevada Division of Water Resources for approval.
Water Rights can seem daunting and complicated. We are licensed Water Rights Surveyors (and Licensed Professional Engineers), and are here to help you with the process. Purchasing, changing, and ultimately proving beneficial use of a water right is a long process (think years, not months). Unfortunately it is very necessary and is governed by Nevada Law and Statutes.
The only way for certain to know if you have water rights on your property is through review of Nevada Division of Water Resources (NDWR) Records. However, just because you have Water Rights on your property, doesn't mean that you own them! This can only be verified through careful title research.
